Terms of Use

Article 1: Purpose

These Terms of Use legally govern the use of the services of the "Ayurveda Yoga Meditation" application and the website www.ayur-vedas.com (hereinafter referred to as "the sites").

Constituting the contract between CMANDCOM and the User, access to the site must be preceded by acceptance of these Terms of Use. Accessing these platforms signifies acceptance of these Terms of Use.

Article 2: Legal notices

The sites are published by the company CMANDCOM.

The sites are hosted by the company ONLINE, located at 5 Rue Keller, 59100 Roubaix, France.

Article 3: Access to the site

"The sites" provide free access to the following services:

Information and applications about Ayurveda, yoga and meditation.
The application is available for free from the Apple and Android stores.
All costs required to access the services (computer equipment, Internet connection, etc.) are the responsibility of the user.

Access to member-dedicated services is done using a username and password.

For maintenance or other reasons, access to the site may be interrupted or suspended by the publisher without notice or justification.

Article 4: Data collection

To create the User's account, the collection of information at the time of registration on the site is necessary and mandatory. In accordance with French Law No. 78-17 of January 6 relating to information technology, files and freedoms, the collection and processing of personal information is carried out with respect for privacy.

Under the French Data Protection Act of January 6, 1978, articles 39 and 40, the User has the right to access, rectify, delete and object to their personal data. This right may be exercised by:

Article 5: Intellectual property

The brands, logos and content of the sites (graphic illustrations, texts, etc.) are protected by the Intellectual Property Code and copyright law.

The reproduction and copying of content by the User requires prior authorization from the site. In this case, any use for commercial or advertising purposes is prohibited.

Article 6: Liability

Although the information published on the site is deemed reliable, the site reserves the right not to guarantee the reliability of the sources.

The information published on the sites is presented for purely informational purposes and has no contractual value. Despite regular updates, the site cannot be held liable for changes in administrative and legal provisions that appear after publication. The same applies to the use and interpretation of the information provided on the platform.

"The sites" decline all responsibility for any viruses that may infect the User's computer equipment after use of or access to this site.

"The sites" cannot be held liable in cases of force majeure or the unforeseeable and insurmountable actions of a third party.

The total guarantee of data security and confidentiality is not provided by the site. However, the site undertakes to implement all required methods to do so to the best of its ability.

Article 7: Hyperlinks

"The sites" may contain hyperlinks. By clicking on them, the User will leave the platform. The platform has no control over and cannot be held responsible for the content of web pages related to these links.

Article 8: Cookies

When visiting the site, a cookie may be automatically installed on the User's browser software.

Cookies are small files temporarily stored on the User's computer hard drive. These cookies are necessary to ensure the accessibility and navigation of the site. These files do not contain personal information and cannot be used to identify a person.

The information contained in cookies is used to improve browsing performance on "the sites".

By browsing the site, the User accepts cookies. They can be disabled through the browser software settings.

Article 9: User publications

"The sites" allow members to publish comments.

In their publications, the member must comply with the rules of Netiquette and the applicable laws in force.

The site reserves the right to exercise prior moderation over publications and may refuse to publish them online without having to provide justification.

The member retains all intellectual property rights. However, any publication on the site implies the delegation of a non-exclusive and free right to the publishing company to represent, reproduce, modify, adapt, distribute and disseminate the publication anywhere and on any medium for the duration of the intellectual property. This may be done directly or through an authorized third party. This includes in particular the right to use the publication on the web and on mobile phone networks.

Each time the publication is used, the publisher undertakes to mention the member's name near the publication.

The User is held responsible for all content they post online. The User agrees not to publish content that could harm the interests of third parties. Any legal proceedings brought by an injured third party against the site must be borne by the User.

The deletion or modification of User content by the site may be carried out at any time, for any reason and without notice.

Article 10: Contacts and communications with other Users

"The sites" allow members to get in touch with other Users. In particular, the directories, courses and events allow users to get in touch with Ayurveda practitioners or yoga teachers (as a non-restrictive example). The User who contacts another user directly or through solicitation (e.g., Ayurveda practitioner or yoga teacher) cannot hold "the sites" responsible for any problems or damages caused by the user or users with whom they have been in contact.

Article 11: Duration of the contract

This contract is valid for an indefinite period. The beginning of the use of the site's services marks the application of the contract with regard to the User.

Article 12: Applicable law and competent jurisdiction

This contract is subject to French law. The absence of an amicable resolution of disputes between the parties implies recourse to the competent French courts to settle the dispute.

Conditions reserved for persons listed in one of the directories

- "The sites" reserve the right to delist you from their directory for any breach, in general of these conditions and code of conduct, and in particular, for any report of actions contrary to French law.

- You certify on your honor that you have provided us with accurate information consistent with your activity. In case of a change in rates or other information, you agree to communicate these to us as soon as possible.

- You agree not to solicit users of "the sites" for practices other than (even related to) Ayurveda and Yoga.

- You agree not to make medical diagnoses regarding users of "Ayurveda Yoga Meditation", and if the situation requires it, to refer them to their attending physician.

- You acknowledge that "the sites" cannot be held responsible for your own actions and communications.
- You may not hold "the sites" responsible in the event of problems causing a bug, or the temporary or permanent shutdown of the "Ayurveda Yoga Meditation" application.
